Welcome to the website and online services of Eden Flowers, LLC (d/b/a “BloomsPal”) (“BloomsPal,” “we,” “us,” or “our”). We operate a commerce and logistics platform that connects Latin American farms, producers and brands (“Suppliers”) with customers in the United States, including through dropshipping / direct import fulfillment (the “Service”).

This Privacy Policy explains what information we collect, how we use and share it, and the choices you have regarding our data practices. By using the Service, you agree to this Privacy Policy and our Terms of Service. If you do not agree, please do not use the Service.

1) Scope

This Policy applies to information we collect through our websites, online portals, and mobile experiences, as well as interactions with our pages on social media platforms and our customer support channels. It does not cover the privacy practices of third parties we do not control (e.g., social networks, app stores, individual Suppliers’ own sites).

2) Information We Collect

A. Information You Provide

We collect information you submit, such as:

  • Contact & account: name, email, phone, delivery/billing addresses, login credentials, preferences.

  • Orders & payments: order details and the minimum payment info necessary to complete a transaction (payments are processed by third-party payment processors under their own terms and privacy policies).

  • Communications: messages you send us (e.g., support requests), product reviews, survey responses.

  • Referrals/contacts (optional): if you invite contacts to BloomsPal, you confirm you have their consent to share their details so we can fulfill your request.

  • Jobs (optional): resume/CV and related information if you apply for a role.

B. Information From Social Media & Chat

If you interact with our social media pages or chatbots, we may receive the information you choose to share (e.g., profile, handle, contact details). Platforms may also provide us with aggregated analytics about our pages.

C. Information From Your Use of the Service (Automatic)

When you visit or use the Service, we automatically collect:

  • Log data: IP address, browser, device type, language/region, date/time, pages viewed, referring/exit pages, and interactions.

  • Device & network: OS, device identifiers, connection info.

  • Usage: features used, content viewed, clicks, time on page, and activity timestamps.

  • General location (e.g., from IP); and precise delivery location when you enter an address for shipment.

D. Information From Other Sources

We may receive information from:
partners (co-branded services, marketing), service providers (fraud prevention, logistics, support), data enrichment providers, and public sources (lawful, publicly available data).

E. If You Are a Supplier

If you onboard as a Supplier, we may collect verification and compliance information (e.g., business contact details, permits or certifications where applicable, tax/settlement information) to create and maintain your account and enable cross-border commerce.

3) Cookies, Pixels & Analytics

We and our partners use cookies, pixels/web beacons, and similar technologies to:

  • operate the Service and keep it secure,

  • remember preferences,

  • understand usage (analytics), and

  • provide and measure marketing (including ads shown off our Site).

You can control cookies via your browser settings. For more info, visit www.allaboutcookies.org. Our Site may use analytics tools (e.g., web analytics services) that set their own cookies—please review those providers’ policies for details and opt-out options.

Do Not Track (DNT): our Site does not currently respond to DNT signals. If that changes, we will update this Policy.

4) How We Use Information

We use information, as permitted by law, to:

  • Provide and operate the Service (marketplace, ordering, fulfillment, account features).

  • Process orders and payments; arrange certified carriers and logistics steps for dropshipping/direct import.

  • Communicate with you (support, order/status updates, policy changes).

  • Personalize & improve the Service, content, and user experience; develop new features.

  • Marketing: send offers or updates we believe may interest you (you can opt-out anytime—see §7).

  • Security & fraud prevention; protect users, Suppliers and BloomsPal.

  • Legal compliance: customs/import, tax, accounting, and other regulatory obligations.

  • Any other purpose disclosed at collection or with your consent.

We may aggregate or de-identify information so it no longer identifies you and use it for any lawful purpose.

5) How We Share Information

We share information as follows:

  • Service Providers: hosting/cloud, customer support, email and communications, payment processing, anti-fraud, analytics, logistics coordination, and similar vendors who process data on our behalf under contractual safeguards.

  • Suppliers: to fulfill your orders, handle product questions, and manage quality/recalls and compliance.

  • Marketing/Advertising Partners: to deliver and measure campaigns (some partners act as processors; others determine their own purposes—review their policies and opt-outs).

  • Promotions: if you enter a promotion, we share as described in the official rules and as required by law.

  • Your Public Content: reviews or profile information you choose to make public on the Service.

  • Business Transfers: during/after mergers, acquisitions, financing, or asset sales, information may be disclosed and transferred as part of the transaction.

  • Legal, Safety & Security: to comply with law or valid legal process; to protect rights, safety, and property; to prevent fraud or abuse; or as otherwise required or permitted by law.

  • Affiliates: within our corporate family under this Policy.

  • At Your Direction or With Your Consent.

We may share aggregated/de-identified information that does not identify you, except where prohibited by law.

6) International Logistics & Data Transfers

Because BloomsPal coordinates cross-border commerce (e.g., LATAM → U.S.), information may be transferred, processed, or stored in the United States and other locations with different data protection laws than your place of residence. We implement safeguards consistent with this Policy and applicable law.

7) Your Choices

A. Cookies & Online Ads

  • Manage cookies in your browser settings (note: disabling certain cookies can impact functionality).

  • Ad choices and device settings may reduce targeted advertising but will not eliminate all ads.

B. Email, SMS & Calls

  • Email: use the unsubscribe link in marketing emails or contact us at privacy@bloomspal.com.

  • SMS: reply STOP to opt out of marketing texts (you may still receive transactional/operational messages, e.g., order updates).

  • Calls: tell our agent you wish to opt out of marketing calls.
You can also adjust notifications in your account settings where available.

C. Access, Update, Delete

You may access, correct, or request deletion of certain information by logging into your account or contacting privacy@bloomspal.com. We may retain data as required by law or for legitimate business needs (e.g., fraud prevention, tax, compliance).

8) Data Retention

We retain information for as long as necessary to provide the Service, comply with legal/financial obligations, resolve disputes, and enforce agreements—then we delete or de-identify it in accordance with our retention policies.

9) Security

We employ commercially reasonable administrative, technical, and organizational measures to protect information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is 100% secure; use the Service at your own risk and take care with email and online communications.

10) Children

The Service is intended for a general audience and is not directed to children. We do not knowingly collect personal information from children as defined by applicable law. If you believe a child has provided information to us, contact privacy@bloomspal.com and we will take appropriate steps to delete it.

11) Third-Party Links

The Service may link to third-party websites or services. Their data practices are governed by their own privacy policies, not this one. We encourage you to review their terms and policies directly.

12) Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated Policy and update the “Last Updated” date. Your continued use of the Service after changes become effective constitutes acceptance.

13) California Notices (Shine the Light & Similar Disclosures)

If you are a California resident, you may request:
(i) a list of the categories of personal information we disclosed to third parties for their direct marketing in the prior calendar year; and
(ii) a list of the categories of third parties to whom such information was disclosed.
To submit a “California Shine the Light” request, email privacy@bloomspal.com with your name, mailing address, email, and phone number. We may need additional information to verify your identity and are only required to respond to one such request per year.

Note: If future U.S. state privacy laws (e.g., CCPA/CPRA, CPA, CTDPA, UCPA, VCDPA) apply to your circumstances, you may have additional rights. Contact privacy@bloomspal.com and we will assist consistent with applicable law.
